The first group comprises freelancers and contractors who are self-employed and can invoice clients for services provided. Contingent workers usually work for <a href=\"https:\/\/www.ilo.org\/global\/research\/global-reports\/weso\/2021\/lang--en\/index.htm\" target=\"_blank\" rel=\"noreferrer noopener\">digital platforms<\/a> on an at-will basis, generally without job security or benefits such as health insurance, life insurance, sick and family leave, vacation days and retirement funds.<\/p>\n\n\n\n<p>And yet, during the pandemic, the share of workers who say they\u2019d choose a contract job over regular employment has risen in some parts of the world.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Proportion of workers who would choose contract work over employed roles<\/h3>\n\n\n\n<div class=\"wp-block-group alignwide\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"flourish-embed flourish-chart\" data-src=\"visualisation\/8130232\"><script src=\"https:\/\/public.flourish.studio\/resources\/embed.js\"><\/script><\/div>\n<\/div><\/div>\n\n\n\n<p class=\"is-style-default\">\u201cThe meaning of job security has been overturned,\u201d says Nela Richardson, chief economist of the ADP Research Institute. \u201cIn April 2020, traditional jobs didn\u2019t have the kind of security people expected when the pandemic hit.\u201d<\/p>\n\n\n\n<p>With widespread layoffs and furloughs, \u201csecure\u201d jobs weren\u2019t necessarily a sure bet. And as people reconsidered what\u2019s important to them, \u201ctime has been elevated in the list of worker priorities,\u201d Richardson says. \u201cIn gig work, you have more autonomy in terms of what you take on.\u201d<\/p>\n\n\n\n<p>Around the world, countries are increasingly exploring ways to improve working conditions for gig workers and provide better social security. Here\u2019s what\u2019s happening around the world in 2022:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">North and South America<\/h2>\n\n\n\n<p>According to a 2020 report by <a href=\"https:\/\/www.adpri.org\/research\/illuminating-the-shadow-workforce\/\" target=\"_blank\" rel=\"noreferrer noopener\">ADP Research Institute<\/a>, gig workers make up 16.4% of the U.S. workforce. In about 40% of U.S. companies, one in four workers is a gig worker, and gig workers comprise more than half of the workforce in almost 20% of companies.&nbsp;<\/p>\n\n\n\n<p>Raj Bhaskar, CEO of <a href=\"http:\/\/hurdlr.com\" target=\"_blank\" rel=\"noreferrer noopener\">Hurdlr<\/a>, a company that helps self-employed individuals track their income and tax deductions, believes there are still a lot of gray areas in how workers are classified.&nbsp;<\/p>\n\n\n\n<p>\u201cWorkers in the U.S. are classified as either 1099 (independent contractors) or W-2 (traditional employees). Gig workers are treated as independent contractors, but a lot of these contractors earn very low wages with no provisions for other benefits such as health insurance or retirement pay,\u201d he says. \u201cThe 1099 classification might need to be loosened, redefined \u2014 or maybe a third classification will be introduced \u2014 to address the gray areas and specific needs of gig workers who are yet unprotected by law.\u201d<\/p>\n\n\n\n<p>Although no federal laws specifically address the status of gig workers, litigation and state initiatives could lead to reclassification. In California, a judge ruled in August that Proposition 22, which allowed app-based gig platforms to continue classifying their workers as independent contractors, was <a href=\"https:\/\/africa.businessinsider.com\/news\/california-judge-rules-prop-22-unconstitutional-dealing-blow-to-gig-worker-initiative\/08dy546\" target=\"_blank\" rel=\"noreferrer noopener\">unconstitutional<\/a> under California law.<\/p>\n\n\n\n<p class=\"is-style-default\">In Canada, a <a href=\"https:\/\/www.benefitscanada.com\/benefits\/health-benefits\/ontario-recommending-introduction-of-new-portable-benefits-program\/\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a> by the Ontario Workforce Recovery Advisory Committee recommended the province develop a portable benefits plan for workers that is not tied to employers. It also suggested the creation of a job board for gig work, which would increase transparency in gig workers\u2019 contracts,&nbsp; and recommended that a new category called \u201cdependent contractor\u201d be created for app-based gig workers. Under the plan, the workers would receive a guaranteed minimum wage and severance pay. In Latin America, <a href=\"https:\/\/www.ilawnetwork.com\/taken-for-a-ride-litigating-the-digital-platform-model\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuits<\/a> brought against digital platforms by workers and parliaments have led countries including Argentina, Brazil and Chile to weigh in on legislation to regulate the platforms\u2019 activity.<\/p>\n\n\n\n<p class=\"is-style-summary-style\"><\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-large\"><img decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/iStock-1366617911-1024x576.jpg\" alt=\"\" class=\"wp-image-1699\" srcset=\"https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/iStock-1366617911-1024x576.jpg 1024w, https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/iStock-1366617911-300x169.jpg 300w, https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/iStock-1366617911-768x432.jpg 768w, https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/iStock-1366617911-1536x864.jpg 1536w, https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/iStock-1366617911-2048x1152.jpg 2048w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\"><meta charset=\"utf-8\"><a href=\"https:\/\/www.istockphoto.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">iStock<\/a><\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Europe<\/h2>\n\n\n\n<p>In the United Kingdom, the number of gig workers tripled between 2016 and 2021; a <a href=\"https:\/\/www.tuc.org.uk\/news\/gig-economy-workforce-england-and-wales-has-almost-tripled-last-five-years-new-tuc-research\" target=\"_blank\" rel=\"noreferrer noopener\">study<\/a> carried out by the University of Hertfordshire and BritainThinks shows that 14.7% of workers surveyed now work on gig economy platforms at least once a week, compared to 5.8% in 2016.&nbsp;<\/p>\n\n\n\n<p>In February 2021, the U.K. Supreme Court <a href=\"https:\/\/www.bbc.com\/news\/business-56123668\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that Uber drivers should be classified as workers. The drivers, previously classified as self-employed, now get paid for the hours they work (rather than being paid only when they have passengers) and have other benefits such as holiday pay, rest breaks and protection against unlawful discrimination. Other countries in Europe have also taken steps to protect gig workers by changing old laws and enacting new ones for the gig economy.&nbsp;<\/p>\n\n\n\n<p>In February 2021, the Milan prosecutor\u2019s office <a href=\"https:\/\/www.ft.com\/content\/6bf8ea68-d035-4cc0-a367-a545c2814355\" target=\"_blank\" rel=\"noreferrer noopener\">fined<\/a> four food delivery platforms a total of \u20ac733 million for violating employment safety laws and classifying riders as independent contractors. Soon after, the platform Just Eat <a href=\"https:\/\/www.reuters.com\/article\/italy-just-eat-workers-idUSL1N2LS1TU\" target=\"_blank\" rel=\"noreferrer noopener\">placed riders on a national contract<\/a> and gave them a minimum wage of \u20ac8.50 ($9.96) per hour, with paid leave, sick leave, social security and insurance, as well as union representation. In <a href=\"https:\/\/www.macaubusiness.com\/italy-backs-off-730-mn-euro-fine-for-delivery-outfits\/\" target=\"_blank\" rel=\"noreferrer noopener\">December<\/a>, prosecutors announced they had reached a deal with the other platforms.&nbsp;<\/p>\n\n\n\n<p>In Portugal, the government approved a <a href=\"https:\/\/www.reuters.com\/technology\/portugals-gig-economy-workers-set-become-staff-2021-10-22\/\" target=\"_blank\" rel=\"noreferrer noopener\">bill<\/a> in October requiring gig platforms such as ride hailing and food delivery companies to grant employee status to their riders and drivers. The bill is currently undergoing parliamentary review.<\/p>\n\n\n\n<p>Some of the new laws have not been well received by gig workers. In Spain, a new <a href=\"https:\/\/www.catalannews.com\/business\/item\/rider-law-comes-into-force-shaking-up-food-delivery-companies\" target=\"_blank\" rel=\"noreferrer noopener\">\u201crider law\u201d<\/a> came into force in August 2021 to give delivery riders full employment rights. Companies\u2019 reactions have varied. Deliveroo decided to pull out of Spain entirely, while other companies changed their algorithms to give riders flexibility but fewer assignments, which means less money for them. Some of the workers said they were worse off with the new law.<\/p>\n\n\n\n<p>In December 2021, the European Commission proposed <a href=\"https:\/\/www.nytimes.com\/2021\/12\/09\/technology\/european-commission-gig-workers-uber.html\" target=\"_blank\" rel=\"noreferrer noopener\">new rules<\/a> for digital platforms that would reclassify up to 4.1 million gig workers as employees.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>The meaning of job security has been overturned.<\/p><cite>Nela Richardson, ADP Research Institute<\/cite><\/blockquote><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Australia<\/h2>\n\n\n\n<p class=\"is-style-default\">In Australia, the gig economy <a href=\"https:\/\/www.insurancebusinessmag.com\/au\/news\/breaking-news\/actuaries-institute-gig-economy-grows-ninefold-242259.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">grew<\/a> nine-fold between 2015 and 2019, to a total worth of about $6.3 billion, with a gain of 32% in 2019 alone. When the pandemic hit and underemployment rose to a record high of 13.8%, more people joined the gig economy to work. <\/p>\n\n\n\n<p class=\"is-style-default\">In the <a href=\"https:\/\/www.aph.gov.au\/Parliamentary_Business\/Committees\/Senate\/Job_Security\/JobSecurity\/Interim_report\" target=\"_blank\" rel=\"noreferrer noopener\">First Interim Report<\/a> presented to the Australian Parliament in June 2021, a Senate committee raised concerns about a lack of basic job protections and low pay for gig workers. The report said that workers should be \u201cpaid at a rate that rightly recognizes the value of the work that they do, that they are provided with other conditions that ensure they do not have to work when they are sick, they are safe at work and their families are not left destitute when they are injured or killed, that they are paid superannuation to underpin a financially stable future, and that they can access other labor protections providing dispute resolution and mechanisms for addressing discrimination and harassment.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Asia<\/h2>\n\n\n\n<p>China has more than 7 million delivery riders who face stressful working conditions, according to studies by Beijing Yilian, a research institute that focuses on labor laws. More than 95% work for more than eight hours a day \u2014 and about 39% work up to 12 hours daily \u2014 to meet demands set by the food delivery platform algorithms.&nbsp;<\/p>\n\n\n\n<p>China\u2019s Administration for Market Regulation issued <a href=\"https:\/\/kr-asia.com\/chinese-government-issues-new-policy-to-protect-food-delivery-workers\" target=\"_blank\" rel=\"noreferrer noopener\">new rules<\/a> in July 2021 to improve riders\u2019 work conditions. Food delivery companies are now required to guarantee a base income and social welfare for their riders. The law also specifies lighter assignment loads, as well as more relaxed performance evaluations and delivery deadlines. The workers must also be able to join unions.<\/p>\n\n\n\n<p>In Malaysia, more than 145,000 delivery riders became <a href=\"https:\/\/www.humanresourcesonline.net\/socso-expands-sps-lindung-to-protect-the-self-employed-under-grab-malaysia-and-foodpanda\" target=\"_blank\" rel=\"noreferrer noopener\">eligible<\/a> for benefits under the Social Security Organization\u2019s SPS Lindung scheme for self-employed people. These workers are now eligible for medical benefits, education and rehabilitation benefits.&nbsp;<\/p>\n\n\n\n<p>Countries such as the <a href=\"https:\/\/newsinfo.inquirer.net\/1478079\/senate-hastening-bill-to-give-mantle-of-protection-to-freelancers-gig-economy-workers\" target=\"_blank\" rel=\"noreferrer noopener\">Philippines<\/a> and <a href=\"https:\/\/rethinkq.adp.com\/singapore-asian-business-hub\/\" target=\"_blank\" rel=\"noreferrer noopener\">Singapore<\/a> are also considering added security for gig workers. In a speech in August, Singapore\u2019s Prime Minister Lee Hsien Loong praised gig workers, whose services were critical during the pandemic. He <a href=\"https:\/\/asia.nikkei.com\/Economy\/Singapore-eyes-gig-worker-welfare-in-wake-up-call-for-ASEAN-startups\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> that the Ministry of Manpower was studying how to create better working conditions for gig workers.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-large\"><img decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/food-delivery-bike-messengers-M41MF1-1024x683.jpg\" alt=\"\" class=\"wp-image-1525\" srcset=\"https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/food-delivery-bike-messengers-M41MF1-1024x683.jpg 1024w, https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/food-delivery-bike-messengers-M41MF1-300x200.jpg 300w, https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/food-delivery-bike-messengers-M41MF1-768x512.jpg 768w, https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/food-delivery-bike-messengers-M41MF1-1536x1024.jpg 1536w, https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/food-delivery-bike-messengers-M41MF1-2048x1365.jpg 2048w, https:\/\/rethinkq.adp.com\/wp-content\/uploads\/2022\/01\/food-delivery-bike-messengers-M41MF1-375x250.jpg 375w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\"><a href=\"https:\/\/www.alamy.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Alamy<\/a><\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Africa<\/h2>\n\n\n\n<p class=\"is-style-default\">In Africa, in the absence of laws focused on gig workers, those workers have been banding together to push for change. A Kenyan court <a href=\"https:\/\/www.pd.co.ke\/business\/economy-and-policy\/relief-for-drivers-as-court-lifts-ubers-corporate-veil-98522\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> in October 2021 that drivers could sue Uber Kenya over alleged contract violations after years of confusion resulting from conflicting domain names and corporate veils.&nbsp;<\/p>\n\n\n\n<p class=\"is-style-default\">In <a href=\"https:\/\/mg.co.za\/opinion\/2021-07-09-choose-platforms-that-support-their-gig-economy-workers-survive-during-a-pandemic\/\" target=\"_blank\" rel=\"noreferrer noopener\">South Africa<\/a>, labor NGOs have encouraged the public to patronize gig platforms that provide some form of security for their workers, especially during lockdowns. A study carried out by the Fairwork Foundation rated the platforms in five areas \u2014 pay, working conditions, contracts, management and representation \u2014 and highlighted platforms that provided financial support, training and safety gear.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Challenges of regulation<\/h2>\n\n\n\n<p>The International Labor Organization said in a <a href=\"https:\/\/www.ilo.org\/global\/research\/global-reports\/weso\/2021\/WCMS_771749\/lang--en\/index.htm\" target=\"_blank\" rel=\"noreferrer noopener\">2021 flagship report<\/a> that there needs to be international policy dialogue and coordination since digital labor platforms operate across multiple jurisdictions.&nbsp;<\/p>\n\n\n\n<p>In a <a href=\"https:\/\/www.ilo.org\/global\/topics\/safety-and-health-at-work\/events-training\/events-meetings\/world-day-for-safety\/33thinkpieces\/WCMS_674004\/lang--en\/index.htm\" target=\"_blank\" rel=\"noreferrer noopener\">paper<\/a> published by the ILO, Cristina Banks of the University of California at Berkeley wrote that gig work will dominate global economies in the future, making it important to address the health and economic risks of gig work now.&nbsp;<\/p>\n\n\n\n<p>\u201cAn interdisciplinary approach could determine how gig workers\u2019 basic needs could be met through changes in work design and the development of worker support systems,\u201d Banks wrote.&nbsp;<\/p>\n\n\n\n<p>By taking steps such as adopting employer-funded compensation for gig workers,&nbsp; implementing community policy and planning, providing legal protections for gig workers, and building better apps, \u201cgig work could be a viable economic and fulfilling career path,\u201d she wrote.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Hurdlr&#8217;s Bhaskar believes that in the future, security for gig workers will be achieved through innovations in the private sector \u2014 not just by government intervention.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>Platforms will realize that making big profits with impoverished workers will no longer work.<\/p><cite>Raj Bhaskar, CEO of Hurdlr<\/cite><\/blockquote><\/figure>\n\n\n\n<p>\u201cJust like companies began to raise starting wages after the pandemic without government intervention, in the near future, market forces will play out in such a way that platforms will realize that making big profits with impoverished workers will no longer work,\u201d he says.<\/p>\n\n\n\n<p>ADPRI\u2019s Richardson says the current debate on the gig economy can be traced back to 2008.
